Terms of service
1. Introduction
These Terms and Conditions apply to the SuperTags.ca website and to transactions related to the products and services offered by SuperTags.ca (a division of Korbyls Management Ltd) (the “Website”). You may also be bound by additional contracts related to specific products or services; if there is any conflict, the terms of those additional contracts will prevail to the extent of the conflict.
2. Binding effect
By registering with, accessing, or otherwise using this Website, you agree to be bound by these Terms and Conditions. Use of the Website implies knowledge and acceptance of these Terms and Conditions, and you may also be asked to explicitly agree to them in certain cases.
3. Electronic communication
By using this Website or communicating with SuperTags.ca by electronic means, you consent to receive communications electronically, including via email and on the Website. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
4. Intellectual property
SuperTags.ca (a division of Korbyls Management Ltd) or its licensors own and control all copyright and other intellectual property rights in the Website and the data, information, and other resources displayed on or accessible through it. Unless otherwise stated, you are not granted any license or other right under copyright, trademark, patent, or other intellectual property rights.
You must not use, copy, reproduce, perform, display, distribute, embed into any electronic medium, alter, reverse engineer, decompile, transfer, download, transmit, monetize, sell, market, or commercialize any resources on this Website in any form without prior written permission, except as permitted by applicable mandatory law.
5. Third‑party property
The Website may include hyperlinks or references to third‑party websites. SuperTags.ca does not monitor or review content on such sites and is not responsible for their privacy practices, content, or terms and conditions. You bear all risks associated with the use of third‑party websites and services and SuperTags.ca is not liable for any loss or damage arising from your disclosure of personal information to third parties.
6. Responsible use
You agree to use the Website only for its intended purposes and as permitted by these Terms and Conditions, any additional contracts with SuperTags.ca, and applicable laws, regulations, and generally accepted online practices. You must not use the Website to distribute malicious software, conduct systematic or automated data collection, or engage in any activity that damages or interferes with the performance, availability, or accessibility of the Website.
7. Registration and accounts
You may register for an account on the Website and may be required to choose a password. You are responsible for maintaining the confidentiality of your password and account information and for all activities that occur under your account. You must not allow others to use your account and must notify SuperTags.ca immediately if you become aware of any unauthorized use or disclosure of your password.
After account termination, you must not attempt to register a new account without prior consent.
8. Refund and return policy For Custom Engraved Products
Custom, engraved, and printed items are not returnable. If an item is incorrect due to your error (for example, incorrect spelling or layout provided in your approved proof), no refund or replacement will be offered. If an item is incorrect due to an error by SuperTags.ca, your order will be re‑made and shipped without undue delay once the issue is verified.
All claims relating to custom, engraved, or printed items must be made by email within 15 days from the day you, or a third party indicated by you (other than the carrier), take physical possession of the goods.
8.2 Hardware and accessories
Unused hardware and accessories may be returnable within 15 days, subject to prior authorization from SuperTags.ca. You must contact SuperTags.ca by email within 15 days of receiving the goods to request authorization and instructions. Returned hardware and accessories may be subject to a restocking fee of up to 15% of the item value.
If the entire order of returnable hardware and accessories is returned, SuperTags.ca will reimburse the price of the returned merchandise, including the original delivery cost for those items (excluding any additional costs for non‑standard delivery options you selected), using the same payment method unless otherwise agreed. If a partial order is returned, SuperTags.ca will reimburse the price of the returned items only, excluding the original shipping cost.
You must send back authorized returns without undue delay, and in any event no later than 15 days from the date you communicate your intent to return; you are responsible for the direct cost of returning items, unless SuperTags.ca shipped the wrong items. SuperTags.ca may withhold reimbursement until the returned items are received and inspected, and you are liable for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the goods.
Please note that there may be legal exceptions to return rights; if such an exception applies, SuperTags.ca will inform you.
9. Terms of ordering and lead times
There may be a minimum order value for certain product categories, such as custom, engraved, or printed products, and hardware and accessories; any such minimums will be indicated on the Website or in your quotation. Lead times for production and shipping will generally be indicated as “usually ships within” a certain number of business days, but these estimates are not guaranteed and may be subject to delays.
Delays in manufacturing, inventory fluctuations, workload, carrier issues, or shortage of materials may affect lead times without liability on the part of SuperTags.ca for such delays. For critical delivery dates, you should contact SuperTags.ca directly to confirm shipping and production timelines.
10. Terms of manufacturing
Digital proofs or mock‑ups are approximations and the final product may differ, including in color, material appearance, and minor layout details. Colors may vary between screens, proofs, and finished products, and color consistency cannot be guaranteed.
Within reasonable manufacturing tolerances, minor variations (including in color, surface finish, and alignment) are not considered defects.
11. Shipping and delivery
Choosing expedited shipping or rush requests does not guarantee same‑day or next‑day shipment. Production and handling time still applies, and you should contact SuperTags.ca to confirm ship dates for time‑sensitive orders.
SuperTags.ca ships from Canada using one or more recognized carriers (for example, Canada Post, UPS, or other major carriers) as indicated at checkout or in your quotation. International orders may be subject to additional customs fees, duties, taxes, or documentation fees, which are your responsibility unless otherwise stated.
If an order is lost in transit, SuperTags.ca may, as a courtesy, offer a discounted replacement, subject to carrier investigations and internal policies in effect at the time.
12. Idea submission
Do not submit any ideas, inventions, or works of authorship that you consider your own intellectual property unless a written agreement (such as a non‑disclosure agreement or IP assignment/licence) is in place. If you submit such content without such an agreement, you grant SuperTags.ca a worldwide, irrevocable, non‑exclusive, royalty‑free license to use, reproduce, store, adapt, publish, translate, and distribute that content in any media.
13. Termination of use
SuperTags.ca may modify, suspend, or permanently discontinue access to the Website or any service at any time, with or without notice. SuperTags.ca is not liable to you or any third party for any such modification, suspension, or discontinuance, and you are not entitled to compensation or other payment, even if features or content you rely on become unavailable.
You must not attempt to circumvent or bypass any access restriction measures on the Website.
14. Warranties and liability
To the maximum extent permitted by applicable law, the Website and all content and services are provided “as is” and “as available” and may include inaccuracies or typographical errors. SuperTags.ca disclaims all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, or non‑infringement, regarding the availability, accuracy, or completeness of the content or services.
Nothing on the Website constitutes legal, financial, medical, or other professional advice; you should consult an appropriate professional for such advice. To the maximum extent permitted by law, SuperTags.ca is not liable for any direct or indirect damages, including loss of profits or revenue, data loss or corruption, or damage to property, arising from your use of the Website or products.
Except where additional contracts specify otherwise, the maximum aggregate liability of SuperTags.ca to you for all claims related to the Website or products and services is limited to the total price you paid for such products or services.
15. Privacy
To access the Website and/or services, you may be required to provide certain personal information. You agree that the information you provide will be accurate, complete, and up to date.
SuperTags.ca takes your personal data seriously and is committed to compliance with applicable Canadian privacy laws, including federal and, where applicable, provincial legislation on personal information protection. Your email address will not be used for unsolicited messages; any emails sent will relate to agreed products, services, or lawful marketing you have consented to receive.
Details on how your personal information is collected, used, and protected are set out in the SuperTags.ca Privacy Policy and Cookies Policy, which form part of these Terms and Conditions.
16. Accessibility
SuperTags.ca is committed to making its content accessible to individuals with disabilities. If you are unable to access any portion of the Website due to a disability, you are encouraged to contact SuperTags.ca with a description of the issue so that reasonable efforts can be made to resolve it in accordance with industry‑standard tools and techniques.
17. Export restrictions and legal compliance
Access to the Website from jurisdictions where the content or purchase of products or services is illegal is prohibited. You may not use the Website in violation of any applicable laws or regulations of Canada, the province or territory where you reside, or other applicable jurisdictions, including export control and sanctions laws.
18. Assignment
You may not assign, transfer, or subcontract any of your rights or obligations under these Terms and Conditions, in whole or in part, without the prior written consent of SuperTags.ca. Any purported assignment in violation of this section is null and void.
19. Breaches of these Terms and Conditions
If you breach these Terms and Conditions, SuperTags.ca may take any action deemed appropriate, including temporarily or permanently suspending your access to the Website, blocking your IP address, or initiating legal proceedings.
20. Force majeure
No party is liable for delay or failure to perform obligations (other than payment obligations) where such delay or failure results from causes beyond that party’s reasonable control, including natural disasters, industrial disputes, interruptions of utilities, or other events of force majeure.
21. Indemnification
You agree to indemnify, defend, and hold harmless SuperTags.ca, its affiliates, officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses arising from your violation of these Terms and Conditions or applicable law, including intellectual property and privacy laws.
22. Waiver
Failure to enforce any provision of these Terms and Conditions does not constitute a waiver of that provision or the right to enforce it later. Any waiver is effective only if in writing and signed by an authorized representative of SuperTags.ca.
23. Language
These Terms and Conditions are drafted and will be interpreted exclusively in English. All notices and correspondence will be in English, unless otherwise required by applicable law.
24. Entire agreement
These Terms and Conditions, together with the SuperTags.ca Privacy Policy and Cookies Policy, constitute the entire agreement between you and SuperTags.ca in relation to your use of the Website and purchase of products or services.
25. Updating of these Terms and Conditions
SuperTags.ca may update these Terms and Conditions from time to time. The revision date at the beginning of the Terms will indicate the latest update, and changes take effect when posted on the Website. Continued use of the Website after updates are posted constitutes your acceptance of the revised Terms.
26. Choice of law and jurisdiction
These Terms and Conditions are governed by the laws of Canada and the laws of the province or territory in Canada where Korbyls Management Ltd is registered, without regard to conflict‑of‑law rules. Any dispute relating to these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of that province or territory, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms and Conditions is found invalid or unenforceable by a court or other competent authority, that provision will be modified, deleted, or enforced to the maximum extent permissible to give effect to the intent of the Terms, and the remaining provisions will remain in full force and effect.
